Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website, content, programs, and services provided by Lifestyle Medicine Sarasota (“we,” “us,” “our”).
By using our website or purchasing/participating in any offerings, you agree to these Terms and to all policies referenced here, including our Privacy Policy and Medical Disclaimer. 
If you do not agree, do not use our website or services.

Eligibility

You must be at least 18 years old to use our website or purchase services. Parents/guardians must supervise any use by minors.
You represent that you have the legal capacity to enter into these Terms and will comply with all applicable laws.

Services Overview

We provide educational content, digital programs (e.g., the 30‑Day Jumpstart), coaching, and, for eligible patients, physician‑led clinical services and telehealth.
Educational programs and general content are not medical advice. See our Medical Disclaimer.
Clinical services are provided only to patients who complete our intake process, are accepted into care, and sign required consents/agreements. Availability may be limited by clinician licensure and other laws.

Accounts & Security

You may need an account to access certain features. Provide accurate information and keep your password confidential.
You are responsible for all activity under your account. Notify us promptly of any unauthorized use or security breach.
We may suspend or terminate accounts for suspected fraud, security risks, or policy violations.

Appointments, Cancellations & No‑Shows

Scheduling: Appointments may be booked online or by phone. A payment method may be required to hold your slot.
Cancellation policy: Please cancel or reschedule at least [24/48] hours in advance. 

Fees, Payment & Insurance

Pricing: Fees are listed at checkout or provided prior to service. Prices are in USD and may change without notice (changes do not affect purchases already completed).
Payment: We use third‑party payment processors. By providing a payment method, you authorize us (and our processor) to charge all applicable amounts, including taxes, fees, and recurring charges if applicable.
Insurance: Unless expressly stated, we do not bill insurance. You are responsible for all charges. We may provide superbills on request, but we do not guarantee reimbursement.

Refunds & Returns

Clinical services: Fees for completed visits, services, and lab orders are non‑refundable.
Digital programs/courses: Unless a specific guarantee is stated on the product page, all sales are final due to immediate access to digital content.
Memberships or packages: Refunds follow the terms stated at purchase; otherwise, unused future sessions may be canceled prospectively, but past/used sessions are non‑refundable.
Supplements/physical goods (if offered): Unopened items may be returned within 30 days of delivery with proof of purchase; shipping is non‑refundable and return shipping is your responsibility. Opened items are not eligible unless defective upon arrival.
To request a refund or return, contact email@lifestylemedicinesarasota.com with your order details.

Subscriptions & Recurring Billing

If you enroll in a subscription or membership, it renews automatically at the stated interval until canceled.
Cancellation: You can cancel anytime before the next billing date via your account or by contacting us at email@lifestylemedicinesarasota.com; cancellations take effect at the end of the current term.
Trials and promos: If a trial converts to a paid plan, your payment method will be charged at the end of the trial unless you cancel beforehand. One trial per user unless stated otherwise.

Chargebacks

If you initiate a chargeback, we may suspend access to services and content while the dispute is investigated. We reserve all rights to contest improper chargebacks.

Communications, E‑Sign & SMS Consent

Electronic communications: You consent to receive emails, texts, and platform messages related to your account, appointments, and services. You agree that electronic signatures and consents have the same legal effect as handwritten signatures.
Marketing messages: With your opt‑in, we may send promotional emails or texts. You can opt out at any time (email unsubscribe link; text reply STOP). Message/data rates may apply.
Sensitive information: Do not send protected health information (PHI) via unsecured email or text. See Privacy & PHI below.

Acceptable Use

Intellectual Property

All content, trademarks, logos, and site materials are owned by Lifestyle Medicine Sarasota or our licensors and are protected by intellectual property laws.
Limited license: We grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the site and any purchased content for your own non‑commercial use, subject to these Terms.
Restrictions: You may not copy, reproduce, distribute, modify, create derivative works, publicly display, sell, or exploit any content without our prior written permission, except as expressly allowed.

User Content & Community Guidelines

If you post, upload, or submit content (e.g., comments, reviews, testimonials, questions), you represent that you own it and it does not violate any rights or laws.
License you grant us: You grant us a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display your content in any media for any lawful purpose, including marketing, subject to our Privacy Policy.
No PHI: Do not submit protected health information (PHI) in public areas. We may remove content at our discretion.

Testimonials, Reviews & Feedback

We may use testimonials, reviews, and feedback you provide, along with your first name and last initial, likeness, and location (city/state), as permitted by law and our Privacy Policy.
Submitting feedback does not entitle you to compensation. We may use your ideas without restriction.

Third‑Party Services & Links

Our site may link to third‑party websites, products, or services. We do not control and are not responsible for third‑party content, policies, or practices. Use third‑party resources at your own risk.

Telehealth, Licensing & Geography

Clinical telehealth services are available only where our clinicians are licensed and as permitted by law. We may be unable to provide clinical services to individuals outside Florida.
Telehealth is not appropriate for emergencies. If you have an emergency, call 911 or go to the nearest emergency department.

Privacy & PHI

Your use of the site is subject to our Privacy Policy, which explains how we collect, use, and protect information.
Do not send PHI through unsecured forms, email, or text. Established patients receive information about secure communication channels and privacy practices applicable to clinical care.

Security

We use reasonable safeguards to protect our site and your information, but no system is 100% secure. You use the site at your own risk.

Disclaimers of Warranties

The site, content, and services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement.
We do not warrant that the site will be uninterrupted, secure, or error‑free, or that defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses arising from or related to your use of the site or services.
Our total liability for any claim arising out of or relating to these Terms or the site will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Lifestyle Medicine Sarasota, its owners, clinicians, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use of the site or services, your violation of these Terms, or your infringement of any rights.

Governing Law & Dispute Resolution

Governing law: These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law principles.
Arbitration: Except for small‑claims matters and injunctive relief, any dispute will be resolved by binding arbitration on an individual basis under the rules of [AAA/JAMS] in or near Sarasota County, Florida. You waive the right to a jury trial.
Class action waiver: Disputes must be brought in your individual capacity and not as a class, collective, or representative action.
Opt‑out: You may opt out of arbitration by sending written notice to email@lifestylemedicinesarasota.com within 30 days of first agreeing to these Terms.

Termination

We may suspend or terminate your access to the site or services at any time, with or without notice, for any reason, including suspected violations of these Terms.
Upon termination, your right to use the site and content ceases immediately. Sections that by their nature should survive termination will survive.

International Use & Export

Our site is intended for users located in the United States. You are responsible for complying with local laws where you access the site.
You may not use or export the site or content in violation of U.S. export laws and regulations.

Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including acts of God, natural disasters, strikes, labor disputes, war, terrorism, riots, pandemics, government actions, utility outages, or internet failures.

Notices

We may provide notices via email, account notifications, or postings on the site. You agree that electronic notices satisfy any legal notice requirements.

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and us regarding the site and services and supersede prior agreements.
If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver.
Provisions that by their nature should survive (including payment obligations, IP rights, disclaimers, limitations of liability, indemnities, and dispute resolution) will survive termination.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
